Purpose and Scope

The Association of Consulting Engineering Companies - Canada (ACEC) respects and upholds an individual's right to privacy and to protection of his/her/their personal information.
This document sets out the policy of ACEC with respect to member contacts, web site visitors, and client representatives.

Who We Are

The Association of Consulting Engineering Companies (ACEC) is a not-for profit organization that has been the voice of Canadian consulting engineering companies since it was founded in 1925. We represent the commercial interests of businesses that provide professional engineering services, to both the public and the private sector. Our members' services include planning, designing and implementing all types of engineering projects, and providing independent advice and expertise in a wide range of engineering-related fields.

ACEC’s member companies directly influence virtually every aspect of quality of life in Canada—economic, social and environmental. Because engineering is a regulated profession, every individual employed by our members is required by law to act “with fidelity to the public interest.”

ACEC is governed by its nearly 400 members: independent consulting engineering companies, organized into 12 provincial and territorial Member Organizations.

Definitions

"Personal information" for the purposes of this policy means information about an individual. It does not include aggregate information which cannot be associated with a specific individual.

"ACEC" for the purposes of this policy means Association of Consulting Engineering Companies -Canada.

"Member contact" for the purposes of this policy is any individual(s) designated by a firm to be a membership contact for ACEC.

"Third party" for the purposes of this policy is an individual or an organization other than the individual from whom or about whom ACEC has collected personal information.

Our Responsibilities

Section 1: Accountability

ACEC is accountable for the personal information under its control. ACEC has appointed a Privacy Coordinator who is responsible for the organization's compliance with this Policy.

Other individuals within ACEC may be delegated to act on behalf of the Privacy Coordinator or to take responsibility for the day-to-day collection and processing of personal information. You may reach the ACEC Privacy Coordinator at tel: (613) 236-0569, email: info@acec.ca.

Section 2: Purposes for Collection, Use, and Disclosure

ACEC collects and uses personal information about individuals for the following purposes:

1. To determine eligibility for membership with us and to communicate with member contacts.
For example, we collect personal information about member contacts in order to enhance the communication in the participation of ACEC’s activities. We collect home address and other personal contact information only in cases where individuals prefer us to use this information to communicate with them.

2. To provide, promote, develop, and enhance membership services and events.
For example, we administer membership surveys and collect certain information on event and activity registration forms. We may use information provided on membership surveys and on event and activity registration forms to provide, promote, develop, and enhance membership services and the events or activities we hold.

3. To comply with legal and regulatory requirements.
For example, we may collect and use personal information to fulfill government reporting requirements.

4. In order to understand and respond to questions.
For example, where inquiries are emailed to us through the "contact us" page on our web site, we collect and use information individuals provide to us for the purpose of understanding their inquiry and responding to it.

Section 3: Consent

ACEC collects, uses or discloses personal information with the consent of the individual. An individual may withdraw consent at any time, subject to legal and contractual restrictions and reasonable notice. Member contacts who no longer wish to receive our newsletter, promotional materials, or affinity programs may opt out of receiving these communications by clicking on the “unsubscribe button” in each communication.  contacting us at info@acec.ca.

Section 4: Limiting Collection

We collect personal information only for the purposes identified above.

As other websites, we use cookies to collect personal information such as IP address and browsing activity on our site. Cookies are small pieces of text sent to your browser to recognize your device.

Some cookies are necessary to make our website function.

Necessary cookies help our website remember information about your visit, make it easier to navigate it as well as to come back to it in accordance with your stated preferences, such as your language preference.

They also collect information about your visit and aggregate it, anonymously, for internal statistical purposes regarding the use of our website. They cannot be disabled as they support the functioning of the website.

ACEC-Canada also uses a LinkedIn Insight Tag to collect user data on visits to our website. We collect the following information: the URL, referrer, IP address, device and browser characteristics (User Agent), and timestamp. The IP addresses are truncated or hashed (when used for reaching members across devices), and members’ direct identifiers are removed within seven days meaning that individuals are no longer directly identifiable. This remaining de-identified data is then deleted within 180 days. This data is shared with LinkedIn, in order to show personalized adds through 3rd party sites and tools such as LinkedIn. LinkedIn members can opt out of the use of their personal data for advertising purposes through their account settings.

Section 5: Limiting Use, Disclosure, and Retention

We do not use or disclose personal information for any purposes other than those stated at Section 2, unless we are required by law, or with consent.

We may share your personal information with our service providers and partners who assist us in providing our services or in marketing for the purposes stated at Section 2 or as required or authorized by law, or with consent. Where personal information is disclosed to a third party for the fulfillment of any purposes identified above, ACEC will make all reasonable efforts, including through contractual clauses, to ensure that the third party has appropriate security procedures in place for the protection of the personal information transferred to it and will never use it for another purpose than the purposes for which the personal information was collected. To find out who our service providers or partners are, please contact our Privacy Coordinator, as indicated in Section 1.

Personal information is retained only as long as is necessary for the fulfillment of the purposes for which it was collected, or as required by law.

Section 6: Accuracy

ACEC will make all reasonable efforts to ensure that personal information is as accurate, complete, and current as required for the purposes for which it was collected. In some cases, ACEC relies on individuals to ensure that certain information about them, such as their contact information, is current, complete, and accurate.

Section 7: Safeguards

ACEC will make all reasonable efforts to ensure that personal information is protected. Safeguards include physical, administrative, and electronic security measures.

The data that is provided to us is stored on secure servers. The transmission of information via the internet is not completely secure and therefore we cannot fully guarantee the security of data sent to us electronically, but we guarantee that we protect personal information with security safeguards appropriate to its level of sensitivity. You are also responsible for the protection of your personal information. For example, where we have given you a password so that you can access our site, you are responsible for keeping this password confidential.

Section 8: Openness Concerning Policies and Practices

ACEC will make available specific information about its policies and practices regarding the management of personal information. To contact us to obtain further information regarding our policies and practices, please refer to Section 1.

Section 9: Access

Individuals have the right to request access to their personal information under the control of ACEC. The Privacy Coordinator will assist individuals with their access requests. Access requests should be made, in writing, to the Privacy Coordinator at ACEC, 130 Albert Street, Suite 420, Ottawa, Ontario K1P 5G4, email: info@acec.ca. We will respond within 30 days.

In certain situations, ACEC may not be able to provide access to personal information that it holds about an individual. An example of where ACEC may not be able to provide access is where to do so would reveal personal information about another individual.

If access cannot be provided, ACEC will notify the individual making the request, in writing, of the reasons for the refusal.

Where your information is inaccurate or incomplete, ACEC will correct the information as required.

If we still have your personal information beyond what was necessary for the purposes for which you provided it, you can request deletion. If indeed it is no longer necessary for those purposes nor required by law to be retained, we will delete it. 

Section 10: Revisions to this Privacy Policy

The development of ACEC's policies and procedures for the protection of personal information is an ongoing process. Due to changes in technology and legal requirements we may revise this policy from time to time. Please ensure that you refer to the current version of ACEC's Privacy Policy. The current version will be posted on our web site at www.acec.ca or made available to you by writing to us at ACEC, 130 Albert Street, Suite 420, Ottawa, Ontario K1P 5G4, email: info@acec.ca.

Section 11: Questions or Concerns Regarding ACEC's Privacy Practices

Individuals may direct their general questions regarding privacy practices at ACEC, as well as any questions or concerns regarding ACEC's compliance with this policy and or spam, to the Privacy Coordinator at the contact information at Section 1.

ACEC will investigate any complaints received in writing. If a complaint is found to be justified, ACEC will take appropriate measures to resolve the complaint including, if necessary, amending its policies and procedures. An individual will be informed, in writing, of the outcomes of the investigation regarding his or her complaint.
